Compliance with current regulations

To comply with the regulatory requirements of the Autorité des marchés financiers (AMF), Real Estate Collective Investment Schemes (OPCI) must regularly establish the net asset value of their units. For general public OPCIs, this assessment must be carried out quarterly by two experts: one responsible for determining the value of the assets, while the other provides a critical review of this valuation. 

Each year, these roles are reversed to ensure an objective assessment. As for professional OPCIs (OPPCI), they have the option of calling on a single expert, but must nevertheless carry out a biannual assessment. Assessment of the initial value of the asset

In addition, it allows them to justify their acquisition decision to their shareholders. By anticipating this valuation, OPCIs can make informed decisions and minimize the potential risks associated with their real estate investments. In recent years, tax authorities have been paying new attention to the distribution of the acquisition price of a real estate complex between the land and the construction. It is now possible for the tax authorities to challenge the distribution made by the taxpayer. 

Recent case law from the Council of State now requires a definitive breakdown of the cost of a real estate complex between the land and the construction on the date of entry into the assets. The distribution between land and construction represents a complex challenge: the value of the land portion can be more volatile than the cost of construction, and it can be out of sync with the market value due to the specificities of the land portion. 

For OPCIs, this distribution represents a potential tax risk in the event of disagreement with the tax authorities.
